Communiqué on the Prevention of Unfair Competition in Imports Has Been Published

Communiqué on The Prevention of Unfair Competition in Imports has been published. Although the effective date of the Communiqué is 29.11.2022, the purpose of the published Communiqué is the opening of a final review investigation regarding the definitive prevention against dumping in force for the import of the colorless flat glass product defined as “Other” goods originating from the Russian Federation and determining the procedures and principles of the investigation opened.

The product subject to the Communiqué is colorless flat glass, defined as “Others” under GTP 7005.29. With the Decision of the Board of Evaluation of Unfair Competition in Imports, it has been decided to open a Final Review Investigation within the framework of article 35 of the Regulation on Unfair Competition in Imports for the product originating in China.

Pursuant to article 23 of the relevant Regulation; professional organizations consisting of the exporter, foreign manufacturer, importer of the goods under investigation, professional organizations with the majority of members consisting of them, the government of the exporting country, the producer of the similar goods in Turkey are considered as interested parties.

However, those who report themselves to the competent authority by answering the questionnaires or presenting their opinions within the periods specified in article 12 of the Communiqué shall be considered as the relevant party in the investigation. Following the opening of the investigation, a notification is made to the known producers/exporters residing in the country subject to the investigation, the Embassy of the country in question in Ankara, and the known importers of the product subject to the investigation identified in the application and determined by the Ministry, regarding the opening of the investigation.

For all interested parties to whom the notification is sent, the response time to the questionnaire is 37 days from the date of the notification regarding the opening of the investigation, including the postal time. Other domestic and foreign parties, other than the first paragraph of article 10 of the Regulation on the Prevention of Unfair Competition in Imports, may present their opinions within the investigation process as of the publication date of this Communiqué without affecting the flow of the investigation.

In the event that one of the parties does not provide the necessary information and documents within the given timeframes and in the requested form within the framework of the provision of article 26 of the Regulation on Unfair Competition in Imports or refuses access to such information and documents, or if it is understood that it hinders the investigation or gives false or misleading information, the said party is deemed not to cooperate.

In such cases, temporary or final determinations within the scope of the investigation can be made, positively or negatively, based on the available data. The measure remains in effect until the conclusion of the investigation.
